आज के तकनीकी युग में ऑनलाइन हैकिंग और फ्रॉड सामान्य घटना हो गई है। इसमें से अधिकांश घटनाएं फ्रॉड के चलते होती हैं। आधिकारिक शिकायत दर्ज ना कराने पर अधिकांश बैंक ग्राहकों को खोई हुई राशि का भुगतान करने में विफल रहते हैं। अब राष्ट्रीय उपभोक्ता आयोग ने फ्रॉड के शिकार ग्राहकों को बड़ी राहत दी है। आयोग ने एक फैसले में कहा है कि यदि हैकर धोखाधड़ी के जरिए ग्राहक के खाते से पैसा चुरा लेते हैं तो नुकसान के लिए बैंक जिम्मेदार होगा।
आयोग ने धोखाधड़ी के लिए बैंक के सिस्टम को जिम्मेदार ठहराया
करीब 12 साल पुराने केस में फैसला सुनाते हुए आयोग ने बैंक के सिस्टम को धोखाधड़ी के लिए जिम्मेदार ठहराया है। एक पीड़िता ने आरोप लगाया कि हैकर ने उसके अकाउंट से पैसे निकाल लिए। इसके लिए ग्राहक ने बैंक के इलेक्ट्रॉनिक बैंकिंग सिस्टम को दोषी ठहराया। अपने फैसले में आयोग ने कहा कि बैंक ने ऐसा कोई सबूत पेश नहीं किया कि जिससे यह पता चल सके कि पीड़ित महिला का क्रेडिट कार्ड चोरी हो गया था। इसके बाद कमीशन ने पीड़िता को हुए नुकसान की भरपाई करने का आदेश दिया।
बैंक ने फ्रॉड होने के दावे को खारिज किया था
ठाणे की जेसना जोस नाम की एक महिला ने 2007 में एक प्राइवेट बैंक से प्री-पेड फॉरेक्स कार्ड लिया था। 2008 में 29 ट्रांजेक्शन के जरिए हैकर ने महिला के क्रेडिट कार्ड से 3 लाख रुपए उड़ा लिए। महिला ने 2009 में जिला उपभोक्ता फोरम में शिकायत दर्ज कराई। इसके अलावा जोस ने लॉस एंजेल्स पुलिस में भी शिकायत दर्ज कराई। बाद में यह मामला राष्ट्रीय उपभोक्ता आयोग में पहुंच गया। आयोग ने बैंक के क्रेडिट कार्ड चोरी होने और इस कारण फ्रॉड होने के दावे को खारिज कर दिया। अब आयोग ने महिला की शिकायत के आधार पर बैंक को 3 लाख रुपए के नुकसान की भरपाई करने का आदेश दिया है। साथ ही आयोग ने कानूनी खर्च और मानसिक पीड़ा के लिए 80 हजार रुपए अतिरिक्त देने का आदेश दिया है। अभी महिला विदेश में रहती है।
RBI की एनुअल रिपोर्ट का दिया हवाला
राष्ट्रीय उपभोक्ता आयोग ने अपने फैसले में रिजर्व बैंक ऑफ इंडिया (RBI) की 2017-18 की एनुअल रिपोर्ट का हवाला दिया है। इस रिपोर्ट में हैकिंग की जिम्मेदारी को लेकर स्पष्ट किया गया है। RBI की रिपोर्ट के मुताबिक, जिसकी लापरवाही से हैकिंग होगी, नुकसान के लिए वही जिम्मेदारी होगा। RBI के नियमों के मुताबिक, बैंक की लापरवाही या गलती की वजह से नुकसान होता है तो ग्राहक को चिंता करने की जरूरत नहीं है। नुकसान की पूरी राशि की भरपाई बैंक को करनी होगी। यदि ग्राहक की लापरवाही से नुकसान होता है तो इसे ग्राहक को वहन करना होगा।
3 दिन में करें फ्रॉड की शिकायत
RBI के नियमों के मुताबिक, बैंक या ग्राहक की लापरवाही ना होने पर ग्राहक को फ्रॉड होने पर 3 दिन के अंदर बैंक में शिकायत दर्ज करानी चाहिए। ऐसा करने पर ग्राहक को पूरे नुकसान की भरपाई होगी। यदि 4 से 7 दिन के अंदर शिकायत दर्ज कराई जाती है तो ग्राहक को 5 हजार से लेकर 25 हजार रुपए तक की भरपाई की जाएगी। 7 दिन के बाद शिकायत दर्ज कराने पर नुकसान की भरपाई बैंक की पॉलिसी पर निर्भर करेगी।
